A Kaduna High Court sitting in Barnawa has granted an appeal in the case of Chapel demolition between Reverend John Joseph Hayab and Mr. Isma’il Umaru Dikko , former Director General of the Kaduna State Urban Development Authority.
The appellant through his counsel Barrister Gloria Mabiem Ballason moved a motion on notice seeking the leave of the court to file the appeal and argument for the appeal brought from the magistrate court to the high court.
In February 2023, the appellant and one other took the respondent Mallam Isma’il Umaru Dikko to the Kaduna State Magistrate Court on charges ranging from demolition of KASU Chapel, criminal trespass, intimidation, assault and causing disappearance of evidence.
The appellant was however dissatisfied with the decision of the Chief Majistrate Court , Taiwo Road Kaduna for rulling against the weight of evidence and therefore filed an appeal at the State High Court.
In its ruling, Justice R. A. Oladoja and Justice Y. Badamasi granted the appellant’s prayers seeking the leave of the court to file the appeal and argument for the appeal in the case.
The case is between Reverend John Joseph Hayab and Dr. Emmanuel Dangana as appellants while Mr. Isma’il Umar Dikko and Mr. Yusuf Abdullahi are the respondents in the case No. KMD/83DC/23
Counsel to the appellant Gloria Mabiem Ballason argued that the respondent acted without authorization and approval demolished of the property thereby defiling the place of worship contrary to section 179 of the penal code laws of Kaduna State 2017.
